The following information relates to a successful prosecution under the South Australian Food Act 2001.

Nature and circumstances of offences under the Food Act 2001:

1. S50: failure to comply with an improvement notice.

2. S21(1):
    a) Food Standards Code 3.2.2. Clause 19(1) – Failure to
    maintain food premise to a standard of cleanliness
    where there is no accumulation of food waste, dirt,
    grease, or other visible matter.
    b) Food Standards Code 3.2.2 Clause 20(1) – Failure to
    maintain food contact surfaces of equipment in a clean
    and sanitary condition.

3. S16(2): sold food that was unsafe.

4. S50: failed to comply with a prohibition order.

Prosecution brought by City of Port Adelaide Enfield
Penalty  Community service order – 150 hours within 5 months.
 2 year good behaviour bond, $500, condition not to
  operate a business for the preparation and/or sale of food
  in South Australia (provided that if the defendant
  undertakes relevant training, he may apply to the court for
  such condition to be deleted).
 $1530.25 costs
