Appeals

A person who receives a notice under section 15, 17, 18, 19, 20 or 21 of the Act may appeal to the PEHC against a requirement or requirements imposed in the notice.

This option does not extend to notices issued under other sections of the Act, or to notices issued under one of the Public and Environmental Health Regulations.

An appeal must be instituted within 14 days of the serving of the notice, unless the PEHC allows an extension of time for instituting the appeal.

The PEHC has produced a fact sheet which provides information to the recipient of such a notice on how to lodge an appeal and the protocol of an appeal hearing. The appeals processes and protocols fact sheet can be downloaded by clicking on the link below.
