Functions

The functions of the PEHC are -

  1. To report (on its own initiative or at the request of the Minister or the Chief Executive of SA Health (the Chief Executive)) to the Minister or the Chief Executive on any matter relating to public or environmental health;
  2. To initiate, carry out or oversee programmes and activities designed to improve or promote public and environmental health;
  3. To promote or, with the approval of the Minister, conduct inquiries into any aspect of public and environmental health;
  4. To keep the operation, administration and enforcement of the Act under review and to recommend to the Minister any legislative or administrative change that appears necessary or appropriate;
  5. To consider and report to the Minister on regulations proposed to be made under the Act;
  6. To carry out any other function or duty assigned to the PEHC by the Minister or by or under the Act.

If, in the opinion of the PEHC, a local council has failed to discharge its duty under the Act, the PEHC must consult with the local council in relation to the matter. If, after consulting with the local council, the PEHC considers that the matter remains unresolved, the PEHC may take such action as appears appropriate.
